1. What TrocaDesk is

TrocaDesk is online software operated by NodyLabs ("we"), based in Houston, Texas. It helps trucking companies manage their loads, drivers, equipment, customers, expenses, settlements and reports.

2. Your account

Whoever creates the account confirms they are authorized to act for the company. The company is responsible for what the users it invites do and for keeping its information up to date.

• Keep your password safe and do not share it. Each person should have their own user.
• Tell us right away if you think someone accessed your account without permission.
• You must be at least 18 years old to use TrocaDesk.

3. Free trial and payments

Every new company gets a 14-day free trial, no credit card required. Before charging for any plan we will publish its price and conditions, and we will not charge you anything without your agreement.

4. Your data belongs to you

The information your company stores in TrocaDesk belongs to your company. We only use it to provide the service, as explained in our Privacy policy. You can ask us for a copy or to delete it at any time.

5. Acceptable use

When using TrocaDesk you agree not to:

• use it for anything illegal or to store information you have no right to store;
• try to access other companies' accounts or data;
• attack, overload or copy the service, or resell access without our permission.

6. The numbers are a tool

TrocaDesk calculates settlements, profit and reports from the data you enter. Review the results before paying your drivers or making decisions. TrocaDesk does not replace your accountant or legal advisor, and it does not guarantee compliance with tax, DOT, FMCSA or IFTA rules: that remains your company's responsibility.

7. Availability

We work to keep TrocaDesk available and to keep backups, but we cannot guarantee it will always work without interruptions or errors. Keep your own copies of important documents, such as invoices, rate confirmations and PODs.

8. Liability

TrocaDesk is provided "as is". To the extent permitted by law, NodyLabs is not liable for indirect losses, such as lost profits, and its total liability does not exceed what your company paid us in the 12 months before the issue.

9. Cancellation

You can stop using TrocaDesk at any time and ask us to delete your account. We may suspend an account that does not follow these terms; when possible, we will warn you first.

10. Changes and governing law

If we make important changes to these terms, we will let you know by email or inside TrocaDesk before they take effect. These terms are governed by the laws of the State of Texas, United States.
